1. About Luxcarib

Luxcarib (the "Site") is an editorial and comparison service that provides information about luxury hotels in the Caribbean and Mexico. Luxcarib does not sell travel, hotel stays, or any other product directly. We are not a travel agent, tour operator, or merchant of record for any booking.

2. Bookings are made with third parties

When you click a "Book Now" link or any hotel image on the Site, you are redirected to a third-party booking partner (currently via Stay22, which connects to providers such as Booking.com, Expedia, and Hotels.com). Any reservation, payment, cancellation, refund, or customer-service matter is between you and the third-party provider. Luxcarib is not a party to that transaction and has no authority to modify, cancel, or refund any booking.

3. Prices, availability, and accuracy

Hotel prices, availability, and amenities displayed on the Site are obtained from third-party data providers and are cached for short periods to keep the Site fast. They may be inaccurate, incomplete, or out of date. The price you see may differ from the price offered at the booking partner. We do not guarantee any price, rate, or availability. Always confirm details with the booking partner before completing a reservation.

4. Editorial content

Articles, destination guides, and "firsthand stay" notes reflect the personal experiences and opinions of the author at a specific point in time. Properties change ownership, management, and quality. Editorial content is not a guarantee of current condition, availability, or fit for any traveler. Search results returned by our live partner API are separate from editorial picks and may include properties Luxcarib has not personally visited.

5. Affiliate compensation

Luxcarib earns commissions on qualifying bookings made through outbound links on the Site, at no additional cost to you. This is our primary source of revenue and may influence which properties or partners we feature, though we aim to recommend only properties we believe represent genuine value. See our full disclosure in the footer of every page.

6. Acceptable use

You agree not to:

• Use automated tools to scrape, crawl, or systematically extract data from the Site beyond standard search-engine indexing;
• Attempt to disrupt, overload, or bypass technical limits of the Site;
• Use the Site for any unlawful purpose or to infringe the rights of others;
• Resell, republish, or commercially redistribute Site content without written permission.

7. Intellectual property

Site content — including the Luxcarib name, logo, writing, photography, and overall design — is owned by Luxcarib or its licensors and protected by copyright and trademark law. Hotel photographs may be licensed from the property, the booking partner, or stock providers. You may link to public pages on the Site and quote short excerpts with attribution; broader use requires permission.

8. Disclaimer of warranties

The Site is provided "as is" and "as available", without warranty of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, secure, or that information displayed is accurate, current, or complete. To the maximum extent permitted by law, we disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, Luxcarib and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site or any third-party booking made through the Site. Our total liability for any direct damages is limited to $100 USD in the aggregate. Some jurisdictions do not allow these limitations; in those jurisdictions, our liability is limited to the smallest amount permitted by law.

10. Indemnification

You agree to indemnify and hold Luxcarib harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising from your misuse of the Site, your violation of these Terms, or your violation of any third-party right.

11. Third-party sites

The Site links to external websites that we do not control. We are not responsible for the content, privacy practices, or availability of any linked site. Your interactions with linked sites are governed by their own terms and privacy policies.

12. Changes to these Terms

We may update these Terms from time to time. The "Effective" date at the top will reflect the latest version. Continued use of the Site after a change constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction there.
